These Terms and Conditions apply to your use of our website and to purchases made through Breeze Block Digital and Mosaic.

By accessing or using our website, placing an order or purchasing a product, you agree to these Terms and Conditions.

If you do not agree with these terms, please do not use the website or place an order.

About our products

Breeze Block Digital and Mosaic creates and sells artwork including art prints and handcrafted mosaic pieces and tables.

Due to the artistic and handmade nature of our products, individual pieces may have slight variations in colour, texture, finish, materials and appearance.

These variations form part of the character of handmade and artistic products and are not necessarily considered faults.

Product images and colours

We make every reasonable effort to ensure product photographs, descriptions, dimensions and other information displayed on our website are accurate.

However, colours may appear differently depending on your screen, device, brightness settings and display configuration.

For handcrafted mosaic pieces, minor variations may also occur because each piece is individually made.

Where dimensions are provided, small variations may occur in handcrafted items unless precise dimensions have been specifically agreed with you.

Product availability

All products are subject to availability.

Some products, including art prints, may be produced specifically after an order is placed.

Handmade or one-of-a-kind products may only be available in limited quantities.

If a product becomes unavailable after you place an order, we will contact you as soon as reasonably possible and arrange an appropriate solution, which may include a refund.

Orders

When you place an order through our website, you are making an offer to purchase the selected products.

You will normally receive an automated email acknowledging your order.

Your order is accepted when we confirm that it has been accepted or begin processing or producing the product.

We reserve the right to decline or cancel an order where reasonably necessary, including where:

  • a product is unavailable

  • incorrect product or pricing information has been published

  • there is a payment issue

  • we reasonably suspect fraudulent activity

  • we cannot deliver the product to the requested location.

If we cancel an order after payment has been received, we will refund the applicable amount.

Changes to orders

Please check your order carefully before submitting it.

Because some of our products are made, printed or prepared specifically for an order, we cannot guarantee that an order can be changed or cancelled once production or processing has begun.

We will let you know whether the requested change is possible.

Nothing in this section limits your rights under the Australian Consumer Law.

Prices and payment

All prices displayed on our website are in Australian dollars (AUD) unless otherwise stated.

Applicable delivery charges will be displayed during checkout, advised separately or quoted before an order is finalised.

Prices and product information may change from time to time.

If an obvious pricing or product information error occurs, we may contact you before fulfilling the order to confirm whether you wish to proceed at the correct price.

Payment must be successfully received before an order is dispatched unless otherwise agreed.

GST

Prices are displayed without GST where GST is not applicable or charged by the business.

If the GST status of the business changes, website pricing and documentation may be updated accordingly.

Promotions and discount codes

From time to time, we may offer promotional discounts or discount codes.

Unless otherwise stated:

  • promotional offers are available only during the advertised promotional period

  • only one promotional code may be used per transaction

  • promotional codes cannot be exchanged for cash

  • promotional codes cannot be applied retrospectively to completed orders

  • additional conditions may apply to individual promotions.

Any additional conditions will be displayed with the relevant promotion.

International orders

International customers are responsible for checking whether a product can be lawfully imported into their country.

International orders may be subject to customs duties, taxes, import charges or other fees imposed by local authorities.

Unless otherwise stated, these charges are not included in the purchase price or shipping charge and are the responsibility of the customer.

Currency conversion fees and exchange rates are determined by your bank, card provider or payment provider.

Art print production and shipping

Our art prints are generally printed to order.

Please allow approximately two weeks for production before dispatch, unless a different timeframe is stated on the product page or communicated to you.

Once your order has been dispatched, tracking details will be provided where tracking is available.

We may offer free Australian delivery on selected art prints. Where free shipping does not apply, the applicable shipping charge will be displayed or advised before purchase.

International shipping charges vary depending on the destination.

Delivery timeframes provided by us or a delivery provider are estimates only unless expressly stated otherwise.

Handling your art print

Art prints are delicate and should be handled with care.

Where your print is supplied in protective packaging, we recommend having the packaging opened and the artwork handled by a professional framer where appropriate.

Care instructions may also be supplied with your artwork.

We are not responsible for damage caused after delivery by inappropriate handling, framing, storage, installation or maintenance.

This does not affect your rights where the artwork was already faulty or damaged when supplied.

Mosaic tables and large mosaic pieces

Because mosaic tables and some larger mosaic pieces require specialist handling and transport, delivery arrangements may need to be quoted separately.

Where this applies, we will contact you to discuss delivery arrangements before the purchase is finalised or dispatched.

Shipping costs may vary depending on:

  • the size and weight of the piece

  • delivery location

  • accessibility

  • specialist handling requirements.

Pre-purchase inspections of available mosaic tables may be arranged by contacting us.

Delivery

You are responsible for providing complete and accurate delivery information.

Please check your delivery address carefully before completing your order.

If an order is returned to us because an incorrect or incomplete address was supplied, additional delivery charges may apply before the item is resent.

We are not responsible for delays caused by circumstances outside our reasonable control, including postal or courier delays, extreme weather, natural disasters, customs processing or other transport disruptions.

Nothing in these Terms limits any rights you may have where goods are not supplied within an agreed or reasonable timeframe.

Damaged deliveries

We take reasonable care when packaging artwork for transport.

If your order appears to have been damaged during delivery, please contact us as soon as reasonably possible.

Where possible, please provide:

  • your name and order number

  • photographs of the external packaging before it is discarded

  • photographs showing the damage to the product

  • a brief description of the issue.

Photographs can help us assess the issue and communicate with the delivery provider.

However, failure to provide photographs within a particular period does not automatically remove any rights you may have under the Australian Consumer Law.

Change-of-mind returns

Because our art prints may be produced specifically for your order and our mosaic pieces may be handmade, unique or one-of-a-kind, we do not generally offer returns, refunds or exchanges simply because you change your mind.

Please choose carefully before placing your order.

We may agree to a change-of-mind return in individual circumstances at our discretion, but we are not required to do so.

This change-of-mind policy does not affect your rights under the Australian Consumer Law.

Faulty, damaged or incorrectly supplied products

Our products come with consumer guarantees under the Australian Consumer Law that cannot be excluded by these Terms and Conditions.

If a product is faulty, damaged, unsafe, significantly different from its description or otherwise fails to meet an applicable consumer guarantee, you may be entitled to a remedy.

Depending on the circumstances and whether the problem is major or minor, this may include:

  • repair

  • replacement

  • refund

  • compensation for reasonably foreseeable loss or damage.

For a major failure, you may have the right to choose between a refund or replacement.

For a minor failure, we may generally choose to repair the product or otherwise provide an appropriate remedy within a reasonable period.

Your rights under the Australian Consumer Law are not limited to a fixed number of days after purchase or delivery.

Returning a faulty product

If a product needs to be returned, please contact us before sending it so we can provide the appropriate return instructions.

Where a product is confirmed to have a problem that entitles you to a remedy under the Australian Consumer Law, reasonable return costs will be handled in accordance with our legal obligations.

For an approved discretionary change-of-mind return, the customer may be responsible for return shipping costs.

We recommend using a tracked shipping service when returning artwork.

Customer responsibility and care

Once your product has been delivered in acceptable condition, you are responsible for appropriate handling, installation, storage, maintenance and care.

Artwork and mosaic pieces should be used and maintained in accordance with any care information supplied.

We are not responsible for damage resulting from misuse, neglect, unsuitable installation, inappropriate storage or failure to follow care instructions.

This does not limit rights that cannot lawfully be excluded.

Website information

The content of this website is provided for general information about our products and business.

We make reasonable efforts to keep information accurate and current, but website content may occasionally contain errors, omissions or outdated information.

We may update website content, product information and availability without notice.

Intellectual property

Unless otherwise stated, the content of this website and the artwork displayed on it are owned by or licensed to Breeze Block Digital and Mosaic.

This includes, without limitation:

  • original artwork

  • photographs

  • artwork images

  • graphics

  • text

  • branding

  • logos

  • website design and layout.

Artwork remains protected by copyright even after the purchase of a physical print or original artwork unless copyright has expressly been transferred in writing.

Purchasing an artwork does not give the purchaser permission to reproduce, copy, distribute, sell copies of, commercially exploit or create derivative reproductions of the artwork.

Website content and artwork images may not be reproduced or used commercially without prior written permission.

Acceptable use of our website

You agree to use our website only for lawful purposes.

You must not:

  • interfere with the operation or security of the website

  • attempt to gain unauthorised access to the website or associated systems

  • introduce malicious software or harmful code

  • scrape, reproduce or commercially exploit website content without permission

  • use our website in a fraudulent, misleading or unlawful manner.

Third-party websites

Our website may contain links to third-party websites.

These links are provided for convenience and do not necessarily mean that we endorse or control the third-party website, business, product or service.

These Terms and Conditions are governed by the laws applicable in Queensland, Australia.

Nothing in this section limits any rights a consumer may have under applicable Australian law.
